Terms and Conditions
Site: NestCurate (nestcurate.com)
Effective date: 12 October 2026
Last updated: 12 October 2026
These Terms govern your use of NestCurate. By using the site, you agree to them. If you do not agree, do not use the site.
Note for Joan: This is a practical starter draft for an editorial travel site, not legal advice. Have a lawyer in your jurisdiction review before treating it as final (especially governing law, liability caps, and consumer rights that cannot be waived in the EU/UK).
1. Who we are
NestCurate is an independent editorial website that publishes guides and resort pages about premium family travel. We are not a hotel, travel agency, tour operator, or booking platform, and we do not sell accommodation ourselves.
Operator: [LEGAL ENTITY / INDIVIDUAL NAME TO CONFIRM]
Contact: [EMAIL TO CONFIRM, e.g. [email protected]]
2. What NestCurate provides
We publish:
- Ranked guides and practical explainers
- Individual resort pages with facts, opinions, and comparisons
- Links to third-party sites where you may check rates or book
Content is for general information only. It is not a personalised travel recommendation, and it is not a substitute for the hotel’s own terms, rates, or availability.
3. No booking contract with NestCurate
If you book a stay, your contract is only with the hotel, airline, transfer provider, or booking platform you use. NestCurate is not a party to that contract and is not responsible for:
- Room availability, prices, taxes, or cancellation rules
- Resort service quality, safety, or changes after publication
- Transfers, visas, insurance, or travel disruptions
Always confirm details directly with the provider before you pay.
4. Editorial independence and rankings
Rankings and “best for” labels reflect NestCurate’s editorial judgement using the rules in our methodology. Hotels do not pay to be included or to change their rank.
If we later accept paid placements or affiliate commissions, we will disclose them clearly and keep paid placement separate from editorial order.
5. Affiliate links and commissions
Some links on NestCurate may be affiliate links (for example Booking.com, Expedia, or similar). If you click and book, we may earn a commission at no extra cost to you.
Affiliate relationships do not change our ranking rules. Where a link is affiliate, we aim to label it in context or in a short disclosure near the booking call-to-action.
6. Accuracy of information
We try to keep facts current and to cite official sources (resort sites, press kits, Michelin, and similar). Hotels change kids-club ages, transfer prices, dining plans, and villa inventories often.
- Facts may be wrong or out of date despite reasonable care
- Opinions and “think twice” notes are subjective
- Guest scores shown from Tripadvisor, Google, or other platforms belong to those platforms and may lag or differ from what you see there
Check the “Sources & last checked” note on each page, then verify critical details with the hotel before booking.
7. Guest reviews and third-party scores
Where we show Tripadvisor, Google, Booking.com, or other platform scores or quotes:
- Those materials are provided by the third party under their terms
- We do not invent NestCurate star ratings from scraped reviews
- We may summarise recurring themes in our own words
- Platform logos and trademarks belong to their owners
We are not responsible for the content of third-party reviews.
8. Photos and intellectual property
Our content
Text, page layouts, logos, and brand elements created by NestCurate are owned by us or licensed to us. You may not copy substantial parts of NestCurate guides or recreate the site for a competing service without written permission.
Short quotations
You may quote short excerpts with clear attribution and a link to the original NestCurate page, for non-misleading commentary or personal use.
Resort photos
Many photographs on NestCurate are provided by hotels or brand press libraries for editorial use, or come from licensed stock. Copyright remains with the photographer or brand. You may not download NestCurate images to reuse on your own commercial site without a separate licence from the rights holder.
Credit lines (for example “Photo: Hilton”) must not be removed when sharing a screenshot for personal use.
9. Acceptable use
You agree not to:
- Scrape, harvest, or systematically download NestCurate content or images with bots, except normal search-engine indexing
- Attempt to break or overload the site
- Misrepresent NestCurate content as your own
- Use the site for unlawful purposes
We may suspend access if we reasonably believe these rules are broken.
10. Third-party websites
Links to hotels, booking platforms, maps, and review sites are provided for convenience. Their terms and privacy policies apply when you leave NestCurate. We do not control and are not responsible for third-party sites.
11. Disclaimer of warranties
The site and all content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, NestCurate and its operator will not be liable for any indirect, incidental, special, consequential, or lost-profit damages, or for any loss arising from:
- Reliance on guides, rankings, or resort facts
- Bookings made via third parties
- Site downtime or data loss
If liability cannot be excluded, our total liability for claims relating to the site is limited to €100 (or the minimum amount required by mandatory law).
Nothing in these Terms limits liability that cannot be limited under applicable law (for example liability for death or personal injury caused by negligence, or fraud).
13. Privacy
How we handle personal data is described in our Privacy Policy (see /privacy). Contact forms, analytics, and affiliate cookies are covered there.
14. Changes to the site or these Terms
We may update content and these Terms at any time. The “Last updated” date at the top will change when we do. Continued use after a change means you accept the updated Terms. For material changes, we will aim to note the update on the site.
15. Governing law and disputes
These Terms are governed by the laws of [JURISDICTION TO CONFIRM — e.g. France / England & Wales], without regard to conflict-of-law rules.
Courts of [CITY / COUNTRY TO CONFIRM] have exclusive jurisdiction, except that consumers in the EU/UK may bring claims in their country of residence where mandatory law requires it.
